Key Terms and Conditions – Open Enrollment Live Training Course Events: Herein “we”, “us” or “our” means CrossSafety Holdings Inc., SkillsCross Learning Inc., and any of our subsidiaries or affiliates. Pre-Event Cancellation or Rescheduling of Event by Client or Registrant: Registrations may be cancelled or rescheduled by Client or Registrant without penalty if we are provided with at least 10 business days notice in advance of the scheduled course date. Cancellation or rescheduling requests received between 5 and 9 business days (excludes Saturday and Sunday) before the session are refundable or re-assignable to a future course date, minus a registration service charge of $125 USD for courses charged in United States Dollars, $175 for courses charged in Canadian Dollars, and $2,700 for courses charged in Mexican Pesos. No refund will be provided in the event of a cancellation or rescheduling request received less than 5 business days prior to the session and are subject to the full session fee. Non-Attendance by Registrant: In the event of non-attendance, the Registrant is responsible for full payment. Pre-Event Cancellation or Rescheduling of Event by Us: We reserve the right to cancel or reschedule delivery of courses at our discretion, up to 5 business days in advance of the scheduled event. In such event we will notify Client / Registrant by the e-mail address providing at the time of registration. Client / Registrant will not be responsible for the course fee or our related costs, and Client / Registrant agrees we shall bear no liability to the Client / Registrant for cancellation or rescheduling. Registrant Substitutions or Rescheduling to Different Session by Client or Registrant: Personnel substitutions and / or Registrant rescheduling to a later course date (up to three (3) times) may be made by the Registrant up to 10 business days before the course without penalty. Language Comprehension: Unless stipulated otherwise, all training content delivered under the SkillsCross, CrossSafety, TRH, SCS or REA banners is delivered in English. It is expected that training participants have a grade 6 level or above comprehension (reading/writing) of English, thus enabling them to effectively participate and complete any applicable course or learning evaluations. Clients are encouraged to contact us to discuss any potential Registrant language comprehension issues. Violence and Harassment: CrossSafety and its affiliate companies have a zero tolerance policy for: a) any behaviours that can be reasonably interpreted as a threat, intent, or action to exercise physical force against our staff; b) any action or unwelcome words that are known or should be known to be offensive, embarrassing, humiliating, or demeaning to our staff. If such was to occur, our staff have been instructed to immediately cease all service delivery, extract themselves from the workplace, and contact their reporting manager. An incident report will be completed, followed by a comprehensive investigation. In the event of discontinuation for the afore-stated reason, the Client agrees to be responsible for payment of the full course fee and related expenses for the cancelled course. Personal Information Security: We take reasonable measures to ensure that our website and computer systems are secure. Please see the terms and conditions of use of our website concerning access to it and use of the facilities on it. We take commercially reasonable steps to ensure that any information provided by you for the purposes of payment will be kept secure. Intellectual Property Rights: You acknowledge that all intellectual property rights in the Training Course and Training Materials anywhere in the world belong to CrossSafety Holdings Inc. and or one of our affiliate companies, that rights in the Training Course and Training Materials are licensed (not sold) to you solely for purposes of your educational experience at our training events, and that you have no rights in, or to, the Training Course or Training Materials other than the right to use them in accordance with the terms of this Agreement. This includes prohibition against re-use of those materials for delivery of training to other persons, copying, reproduction, re-distribution, re-publication or creation of any derivative works. Inclement Weather and Force Majeure: We reserve the right to postpone/cancel/re-schedule services if predicted weather conditions can reasonably be considered to present a safety hazard for our staff. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control (Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control. In such circumstances we will engage the client representative as soon as it is feasible to discuss alternative options. Scents and Fragrances: To create a secure and comfortable indoor environment for individuals with chemical sensitivities, we respectfully request that all attendees at our training sessions limit the use of scented products.
